Your personal information is being collected by the Department of Health, Disability and Ageing (the department/ we).
Authorisation to collect this information
The collection of this information is required by the Aged Care Act 2024 and the Aged Care Rules 2025.
Why we collect this information
We collect personal information in the 24/7 registered nurse obligation exemption application form for the purpose of determining your approved residential care home’s eligibility for an exemption from the 24/7 registered nurse obligation.
What would happen if we did not collect this information
If you do not or are unable to provide your personal information the department will not be able to consider your application for an exemption from the 24/7 registered nurse obligation.
Who we disclose this information to
The department will disclose information collected in the 24/7 registered nurse obligation exemption application form to the Aged Care Quality and Safety Commission (the Commission), for the purposes of the Commission providing information to the System Governor of the department, or delegate, that is relevant the System Governor’s, or delegate’s, consideration of whether the steps you have taken to meet the clinical care needs of individuals at your approved residential care home while an exemption is in force, are reasonable in the circumstances.
The department will also share information collected in this application form with the Commission to the extent relevant to its functions and regulatory activities. If a decision is made to grant an exemption, the System Governor, or delegate, is required to make publicly available the following information about the exemption:
- the name of the registered provider and approved residential care home;
 - the period for which an exemption in force;
 - any other conditions that apply to the exemption; and
 - any other information of a kind specified in the Aged Care Rules 2025.

The department’s privacy policy contains information about how you may access and seek correction of personal information about you that is held by the department.
Privacy complaints
The department’s privacy policy contains information about how you may complain about a breach of the Australian Privacy Principles or the Australian Government Agencies Privacy Code and how the department will deal with complaints.
Overseas disclosure of your personal information
We will not disclose your personal information to any overseas recipients.
