New laws for vapes

The Australian Government is changing the laws around vapes.

The Australian Government wants to protect young people from the harms of vaping and nicotine dependence. 

From 1 January 2024, some of the laws around vapes changed. Some of these changes came into effect on 1 January and others came into effect on 1 March 2024. 

The changes affect the:

  • import
  • availability
  • advertising
  • sale of vaping products and liquids (including nicotine and non-nicotine)
  • travellers' exemption
  • access through the Personal Importation Scheme.

The Therapeutic Goods Administration (TGA) has strengthened the requirements for therapeutic vaping products. Information about standards for vaping products sold in Australia can be found on the TGA website.

More changes to vaping laws in 2024

There will be more changes coming in 2024. These include stopping the manufacture, supply, advertisement and commercial possession of non-therapeutic and disposable single use vapes.

The coming changes will:

  • increase the minimum quality standards for requiring pharmaceutical-like packaging
  • reduce the allowed nicotine concentrations and volumes in vapes
  • ban the sale of all single-use, disposable vapes
  • ban the sale of all non-therapeutic vapes
  • limit the sale of therapeutic vapes so people can only obtain them from pharmacies.

Since 1 January 2024, it has been illegal to import disposable vapes. Since 1 March 2024, it has been illegal to import non-therapeutic vapes. Retailers have a limited window of time to sell-down their stocks of disposable and non-therapeutic vapes in accordance with existing laws. These laws include prohibiting the sale of vapes containing nicotine without a prescription.

The new Public Health (Tobacco and Other Products) Act 2023 starts from 1 April 2024. The same bans that apply to tobacco advertising and sponsorship bans will apply to vapes.
