Three Health Insurance Rules administered by the department were due to sunset (cease) in October 2025. These were the:

These Rules provided the legislative basis for administration and application of the risk equalisation pool.

It was proposed that the Rules remained fit for purpose and should be replaced substantially in the same form.

The department consulted with relevant government agencies who provided support for this approach. Public consultation occurred between January and March 2025, with all respondents supporting the proposed remake of the Rules.

The Rules have therefore now been remade.

The Private Health Insurance (Risk Equalisation Policy) Rules 2025 provides the method by which payments to and from the risk equalisation pool are calculated. These Rules were registered on 4 August 2025 on the Federal Register of Legislation and commence from 30 September 2025. The Private Health Insurance (Health Benefits Fund Policy) Rules 2025 defines health related business and the jurisdictions for the risk equalisation pool. These Rules were registered on 4 August 2025 on the Federal Register of Legislation and commence from 5 August 2025. Further details on the Amendment Rules can be found in the accompanying Explanatory Statement.

The Private Health Insurance (Levy Administration) Rules 2025 provides the date that certain levies are imposed. These are the Complaints, Risk equalisation, Medical devices and human tissue products and National joint replacement levies. These Rules were registered on 6 August 2025 on the Federal Register of Legislation and commence from 7 August 2025.
