We have reviewed this legislation to make sure that it:

  • is still effective
  • responds to changes in technology.

What we reviewed

The review looked at:

  • what is working well in the current legislation
  • what, if any, changes we can make to the legislation
  • whether any provisions in the legislation are redundant
  • whether any parts of the legislation are overcomplicated, ambiguous or unclear
  • whether regulations can be simpler and easier to enforce
  • any other aspects of tobacco control that the Australian Government should consider and prioritise.

How we reviewed this legislation

We involved a range of stakeholders when we reviewed legislation.

For the review process we:

  • ran a public consultation from January to March 2019
  • ran a series of stakeholder workshops from May to July 2019
  • ran a public consultation – including exposure draft legislation – from 31 May 2023 to 14 July 2023
  • are running a further public consultation between 11 December 2023 and 8 January 2024. It focuses on draft regulations and contains more detail on the proposed graphic health warnings and health promotion inserts.
