Why apply
Apply for a declaration under the Commonwealth Qualified Privilege Scheme to encourage health professionals to take part in your quality assurance activity.
Who can apply
Organisations can apply if they meet the eligibility criteria. The application must be for an eligible activity.
Application form
You must complete the form in full. This allows for a detailed assessment against the requirements in the legislation. Before completing the form, we recommend you read:
- Part VC of the Health Insurance Act 1973
- Part 10, sections 84 to 89 of the Health Insurance Regulations 2018.

Timeframes
We recommend you apply at least 6 months before you plan to start your activity. This allows for enough time to process your application.
Application process
After you apply:
- we email you to confirm we have received your application
- the Minister for Health (or delegate) considers your application.
The Minister for Health (or delegate) must ensure:
- the application meets eligibility
- it is in the public interest to grant qualified privilege.
For example, it may be in the public interest because it will encourage:
- participation in the activity
- more participation (if the activity has previously been undertaken)
- actions to accept, implement or monitor any recommendations from the activity.
The Minister for Health (or delegate) may also consider if the activity has, or should have, ethics committee approval.
Outcome
If your application is successful:
- the Minister for Health (or delegate) will make a declaration
- we will let you know the outcome so you can start running the activity.
If your application is not successful, we will let you know the outcome and the reasons for the decision.
