This discretionary power is only available to a pharmacist who has made an application for approval, and their application was not approved because it did not meet the requirements of the Pharmacy Location Rules.
To consider a request for the exercise of Ministerial Discretion, the Minister must be satisfied that:
- the decision not to approve the pharmacist will result in a community being left without reasonable access to the supply of pharmaceutical benefits by an approved pharmacist; and
- it is in the public interest to approve the pharmacist.
