Reason for Sanction:
The approved provider has not remedied continued non-compliance with its prudential responsibilities.

The issues of concern are in relation to:
* the responsibility under 57-21(1)(a) of the Act to refund accommodation bonds.
* the responsibility to comply with the Prudential Standards, in particular the Liquidity Standard which requires the provider to maintain sufficient liquidity.
* the responsibility to comply with the Prudential Standards in particular the Disclosure Standard which requires the provider to provide care recipients (or their representative) with information in relation to bonds.
* the responsibility to comply with the Prudential Standards in particular the Liquidity Standard which requires the provider to maintain a compliant liquidity management strategy.
* the responsibility under section 63-1(1)(c) of the Act to provide information under section 9-3B(4) of the Act.

Revocation of approved provider status, unless an adviser, with a clinical background and nursing experience, who has the appropriate skills, qualifications and background to assist the approved provider to comply with their responsibilities, and is approved by the Commonwealth, is appointed by the approved provider for a period of six (6) months.

2. Revocation of approved provider status, unless the approved provider agrees to provide relevant training within six (6) months, at its expense, for its officers, employees and agents to support them in meeting the needs of care recipients.

3. The approved provider is not eligible to receive Australian Government subsidies for any new care recipients for a period of six (6) months.

Reason for Sanction:
The Accreditation Agency provided the Department with a report that identified serious risk at the service.

The Department identified serious issues of concern, including:

*Information systems are not supporting the delivery of care to residents with complex care needs;
*Residents' pain is not being managed appropriately;
*Residents' challenging behaviours are not being managed appropriately placing residents at risk of harm; and
*Residents' medications are not being managed appropriately.



Current Status of Service:
The Department and the Agency are continuing to monitor the service.

The Residents and Representatives meeting was held on 3 December 2012.

A Nurse Adviser has commenced work at the Service.

On 13 December 2012, the Accreditation Agency made a decision that serious risk at the service had been resolved.

On 28 February 2013 sanction 3 was lifted.

The Department identified serious issues of concern, including:

The issues of concern include:
*Clinical instructions are not available to guide staff practice and poor practice is not followed up;
*Residents' behaviours are not being managed appropriately, placing residents' safety at risk or compromising residents' privacy;
*Residents' medications are not being administered as prescribed, particularly in the management of residents' challenging behaviours;
*Residents' who smoke are not being consistently assisted to do so in a safe manner; and
*Information is not available to staff to inform the provision of appropriate care and services to residents.


Current Status of Service:
The Department and the Accreditation Agency are continuing to monitor the Service.

The Residents and Representatives meeting was held on 2 January 2013.

A Nurse Adviser has commenced work at the Service.

On 18 January 2013, the planned closure of Reservoir Retreat was completed. Residents of the Service have moved to suitable alternative accommodation.
