Reason(s) for Notice:
Aged Care Act 1997

Part 4.2, Paragraph 56-1(a) of the Act requires the approved provider to comply with the requirements of Division 57 in relation to any accommodation bond charged for the care recipient's entry into a residential care service. In particular:

*Paragraph 57-21(1)(a) - Which requires the approved provider to refund accommodation bonds following the death of a care recipient within the timeframe required, in particular:
- Paragraph 57-21(3)(aa) - The accommodation bond must be refunded if the care recipient dies - within 14 days after the day on which the approved provider is shown the probate of the will of the care recipient or letters of administration of the estate of the care recipient.

*Paragraph 57-2(1)(c) - Which requires the approved provider to comply with the Prudential Standards made under Section 57-4 of the Act, in particular:
- The Liquidity Standard set out in Subdivision 3.2 of the User Rights Principles 1997, Section 23.36 - which requires the approved provider to maintain sufficient liquidity to ensure accommodation bonds can be refunded.
- The Disclosure Standard set out in Subdivision 3.4 of the User Rights Principles 1997, Section 23.42 - which requires the approved provider to provide care recipients (or their representatives) for whom the accommodation bond is held, the information as required.
- The Liquidity Standard set out in Subdivision 3.2 of the User Rights Principles 1997, Section 23.37(2)(b) - which requires the approved provider to ensure that the liquidity management strategy is up to date and meets the requirements set out in Section 23.37(1) of the Principles.
