The Agency notified the Department that the risk to residents no longer exists. The Approved Provider applied for reconsideration of its accreditation status.

The Agency reconsidered the accreditation status and decided that the facility will be accredited until 9 January 2003.

The Accreditation Agency will monitor the facility's improvement plan on a regular basis.

The Approved Provider applied for the lifting of sanctions.

The Sanctions were lifted on 10 January 2001.

Reason for Sanction:

The Accreditation Agency provided the Department with a report that identified serious risk at the home. The report included evidence that residents were at risk of harm from physical and verbal assault, poor infection control practices and deficiencies in the physical environment.

The Department identified serious issues of concern, including:

management have not discharged their responsibilities in relation to resident abuse and compulsory reporting requirements;

there are insufficient appropriately skilled and qualified staff to meet the needs of residents;

the clinical care provided to residents is not effective;

behaviour management at the home is not appropriate or effective;

the privacy and dignity of residents is compromised by management and staff attitudes and behaviours; and

there are significant hazards in the physical environment of the home which pose a risk to residents.


Current Status of Service:

On 4 January 2012, the Accreditation Agency made a decision that serious risk at the home has been mitigated.

On 5 January 2012, the planned closure of Kings Park Nursing Home was completed. Residents of the home have moved to suitable alternative homes.

Reason for Sanction:
The sanction was imposed due to a breach of the Accountability Principles under the Aged Care Act 1997 where the Approved Provider failed to allow the Aged Care Standards and Accreditation Agency (ACSAA) access to the home in order to undertake its monitoring role.

Current Status of Service:
The Agency has recommenced visits to the home. The Department continues to monitor the service.

On 23 November 2004 the approved provider applied to have the sanction lifted. Following consideration of the information in the application the Department has not lifted the sanction.

On 15 December 2004 the approved provider re-applied to have the sanction lifted. The Delegate is considering the application. Following consideration of the information in the application the Department has not lifted the sanction.

On 10 March 2005 the approved provider made further application to have the sanction lifted.

On 15 March 2005, the Delegate considered the information and decided to lift the sanction.

Reason for Sanction:
The Aged Care Standards and Accreditation Agency (the Agency) identified serious risk at the home. Subsequently the Department decided the following issues posed an immediate and severe risk to residents:

Staff do not have sufficient and/or accurate information to ensure care is provided in accordance with residents’ individual needs or changes to care needs.

Not all staff have appropriate skills and knowledge to perform their roles and responsibilities.

Information systems and communication in relation to medication management and the provision of clinical care are ineffective.

Processes for identifying and managing residents’ pain are ineffective resulting in residents not being as free from pain as possible.

Residents are not receiving adequate nutrition and hydration; and

Residents with challenging behaviours are not being effectively managed.



Current Status of Service:
The Department and the Agency are continuing to monitor the service.

Resident and Representative meeting was held on Thursday 14 July 2011 at 2pm.

Sanctions in place.

Administrator and Nurse Adviser have commenced work at the Home.

On 16 August 2011, the Accreditation Agency made a decision that serious risk at the home has been mitigated.

Sanctions 3 and 4 expired on 5 January 2012.
