Aged Care Act 1997
Failure to comply with the responsibilities of approved providers in regard to Quality of Care. Part 4.1, section 54-1(1) (a), which requires that approved providers provide such care and services as are specified in the Quality of Care Principles 1997. Specifically, Schedule 1, Part 2, Item 2.4 Treatments and procedures which requires approved providers to ensure that treatments are procedures are carried out according to the instructions of a health professional.

Schedule 1: Charter of residents' rights and responsibilities
Part 4.2, section 56-1(l) of the Act, which requires approved providers not to act in a way which is inconsistent with any rights and responsibilities of care recipients that are specified in Schedule 1 to User Rights Principles 1997 which is the ‘Charter of Residents’ Rights and Responsibilities’ (the Charter). The Charter states, in part, that each resident of a residential care service has the right to quality care appropriate to his or her needs.
