1. Revocation of approved provider status, unless an adviser, with experience in human resource management - and with clinical background and knowledge in aged care, approved by the Commonwealth, who has the appropriate skills, qualifications and background to assist the home to comply with their responsibilities is appointed by the approved provider.

2. The approved provider is not eligible to receive Australian Government subsidies for any new care recipients for a period commencing on 1 June 2012 and ceasing to have effect seven (7) days after an adviser commences work at the service.

3. Revocation of approved provider status unless the approved provider agrees to provide relevant training within four (4) months , at its expense, for its officers, employees and agents to support them in meeting the needs of care recipients.

Note: These sanctions apply to two co-located services.

Reason for Sanction:
The Accreditation Agency provided the Department with a report that identified serious risk at the home.

The Department identified serious issues of concern, including:

* Residents are at risk due to the poor staff practices and lack of understanding of residents’ needs displayed by care staff at the home;

* The home is not accessing resources to assist in gathering information from residents about their well-being needs. Without the ability to identify residents’ specific emotional support needs related to their cultural background and kinship relationships there is a serious risk that these needs are not met;

* Documented care and lifestyle information for residents is not being communicated effectively to staff who do not have English as their first language; and

* Where information about resident specific wellbeing needs have been identified staff are unaware of these needs and are not providing support specific to these needs.

Current Status of Service:
The Department and the Accreditation Agency are continuing to monitor the service.

The Residents and Representatives meeting was held on 12 June 2012

On 19 June 2012 serious risk was resolved.

A Nurse Adviser has commenced at the service.

Sanction 2 expired on 28 June 2012.

Sanction 3 expired on 30 September 2012.

The Aged Care Standards and Accreditation Agency (the Agency) identified serious risk in relation to:

Staff not monitoring or responding to distressed residents.

Inadequate supervision of residents by staff and lapses in perimeter and internal security do not maintain a safe environment consistent with residents' care needs.

The safety and security of residents and their belongings is compromised by delays in maintenance of equipment, the grounds and the fencing surrounding the home.

The presence of rodents in the home is a risk to resident's health and safety. The temperature and amenity of the living environment is not maintained consistent with the safety and comfort needs of residents.


Current Status of Service:
Nurse Adviser commenced 2 May 2011.
Sanctions expired 17 October 2011.

The Agency identified serious risk, in relation to Expected Outcome 1.6 Human Resource Management, 2.11 Skin Care and 2.13 Behavioural Management.

Current Status of Service:
The Approved Provider appointed an administrator on 30 October 2007. A clinical nursing adviser has also been employed to assist the administrator.

On 31 October 2007, the Agency advised that serious risk was mitigated.

Sanctions 1 and 2 expired on 16 April 2008

The Agency advised that Serious Risk was mitigated on 30 April 2009.

The Service has appointed an Adviser.

Sanction 1 expired on 28 November 2004

Sanction 2 staff to undertake training was lifted on 1 October 2004.
