*Revocation of approved provider status unless an adviser with a clinical background and nursing experience approved by the Commonwealth, who has the appropriate skills, qualifications and background to assist the home to comply with their responsibilities, is appointed by the approved provider for a period of six (6) months.

*The approved provider is not eligible to receive Australian Government subsidies for any new residents for a period of six (6) months.

*Revocation of approved provider status unless the approved provider agrees to provide relevant training within six (6) months, at its expense, for its officers, employees and agents to support them in meeting the needs of residents.

*Revocation of approved provider status unless an administrator, approved by the Commonwealth who has the appropriate management, clinical and quality systems experience to assist the approved provider comply with its responsibilities, is appointed for a period of six (6) months.

Reason for Sanction:
On 3 February 2012, the Department reconsidered the original sanctions decision of 25 January 2012. The Department received additional information from the Accreditation Agency that indicates the non-compliance at the home is more widespread than was initially evident.

The Department identified serious issues of concern, including:

*Residents’ medication is not managed safely. Sufficient stocks of medication are not maintained resulting in residents not receiving their medication as prescribed.

*Residents’ pain needs are not managed appropriately. Residents do not receive their pain medication when required resulting in residents being in pain unnecessarily.

*Residents’ nutritional needs are not being met, including residents who have special feeding requirements, resulting in residents losing weight.

*The comfort and dignity of terminally ill residents is not maintained.

*A lack of clinical oversight.

*Clinical care is not consistently provided as directed and/or prescribed.

*Residents' wounds are not managed appropriately.

Current Status of Service:
The Department and the Accreditation Agency are continuing to monitor the service.

The Residents and Representatives meeting was held on 1 February 2012.

A Nurse Adviser and Administrator have commenced at the service.

On 29 February 2012, the Accreditation Agency made a decision that serious risk had been resolved at the Nursing Home.

The Accreditation Agency provided the Department with a report that identified serious risk at the home.

The Department identified serious issues of concern, including:
* there is insufficient trained staff resulting in residents care needs not being met promptly or appropriately;

* staff do not have the knowledge to effectively manage residents care needs, such as residents with challenging behaviours; residents' continence needs; residents' pain needs and medication administration;

* medication is not managed safely or correctly;

* residents pain is not managed effectively;

* residents clinical care needs are not managed effectively; and

* there is a lack of clinical oversight and monitoring.

Current Status of Service:
The Department and the Accreditation Agency are continuing to monitor the service.

The Residents and Representatives meeting was held on 10 February 2012.

A Nurse Adviser and Administrator have commenced at the service.

On 23 February 2012, the Accreditation Agency made a decision that serious risk had been resolved at the Hostel.
