Private Health Insurance (Incentives) Amendment Rules 2013 (No. 1) and Private Health Insurance (Complying Product) Amendment Rules 2013 (No. 5)

The Private Health Insurance (Incentives) Amendment Rules 2013 (No. 1) and the Private Health Insurance (Complying Product) Amendment Rules 2013 (No. 5) were registered on the Federal Register of Legislative Instruments on 2 January 2014. The Rules can be found on the Australian Government ComLaw website.

These legislative instruments give immediate effect to the Government’s simplification of the Private Health Insurance Rebate – Indexing the Government’s Contribution.

Private Health Insurance (Incentives) Amendment Rules 2013 (No. 1)

The Incentives Amendment Rules amend the Private Health Insurance (Incentives Rules 2012 (No. 2), which commenced on 4 July 2012. The Rules insert a new section 5A to determine the weighted average ratio for the purposes of subsection 22-50(5) of the Private Health Insurance Legislation Amendment (Base Premium) Act 2013. The weighted average ratio is used to calculate the base premium for product subgroups defined under section 63-5 of the Act.

The Private Health Insurance (Complying Product) Amendment Rules 2013 (No. 5)

The Complying Product Amendment Rules amends part 2 of the Private Health Insurance (Complying product) Rules (No. 2) which commenced on 14 January 2011. The Rules create new product subgroups so that, from 1 April 2014, the weighted average ratio as defined in subsection 22-50(5) of the Act is applied to every complying health insurance policy.
