Private Health Insurance (Complaints Levy) Amendment Rules 2010 and payment of the 2010 Private Health Insurance Complaints Levy

Purpose

The purpose of this Circular is to inform private health insurers that the Private Health Insurance (Complaints Levy) Rules 2007 have been amended in line with the 2010/11 budget for the Private Health Insurance Complaints Levy. It also advises insurers about arrangements for invoicing and payment in respect of this year’s Complaints Levy.

2010 Complaints Levy Calculation

The 2010 Budget provided a Private Health Insurance Complaints Levy of $1.964 million to support the work of the Private Health Insurance Ombudsman.

The amount to be collected from each insurer as a proportion of the total budget is calculated according to the formulas set out in the Private Health Insurance (Complaints Levy) Rules. These formulas utilise data on the number of single and joint policies that insurers had as at 30 June 2010 as reported to the Private Health Insurance Administration Council.

The levy to be paid by some insurers will increase by a small amount this year. This is due to an increase in the budget as well as any increases in that insurer’s policy numbers.

Complaints Levy Amendment Rules

In order to meet the Complaints Levy budget, small amendments have been made to the formulas in the Private Health Insurance (Complaints Levy) Rules 2007. These amendments are set out in the Private Health Insurance (Complaints Levy) Amendment Rules 2010 which came into effect on 18 December 2010.

The Rules and the Amendment Rules are available on the ComLaw website as follows: A compilation of the Rules incorporating the 2010 will be prepared as soon as practicable.

2010 Complaints Levy Invoices

Invoices in respect of the Complaints Levy are currently being prepared by the Department and will be dispatched shortly. Complaints Levy invoices are usually payable on 31 December each year. However, as there has been a delay in dispatching the invoices, the invoices will be due on 28 January 2011 on this occasion.
