Private Health Insurance (Benefit Requirements) Amendment Rules 2010 (No. 6) and Private Health Insurance (Complying Product) Amendment Rules 2010 (No.4)
The Private Health Insurance (Benefit Requirements) Amendment Rules 2010 (No. 6) (the Benefit Requirements Amendment Rules) and the Private Health Insurance (Complying Product) Amendment Rules 2010 (No. 4) (the Complying Product Amendment Rules) were registered with the Federal Register of Legislative Instruments (FRLI) and took effect on 20 September 2010 (FRLI No: F2010L02497 and FRLI No: F2010L02498 respectively).
These Rules amended the Private Health Insurance (Benefit Requirements) Rules 2010 and the Private Health Insurance (Complying Product) Rules 2010.
The Benefit Requirements Amendments Rules
Amendments have been made to Schedule 4 to increase the minimum benefits for Nursing-Home Type Patients (NHTP) in public hospitals in Queensland and Tasmania, and to decrease the minimum benefit payable for NHTPs at private hospitals. Changes to minimum benefits payable for NHTPS are:
- Queensland from: $96.00 to $98.50;
- Tasmania from: $113.65 to $116.05; and
- Private hospitals from: $63.75 to $62.75.

The Complying Product Amendment Rules
Amendments have been made to Part 2, Rule 8A Benefit Requirement- Nursing-Home Type Patients. The Rules increased the amount of NHTP contribution payable by patients at private hospitals and public hospitals in New South Wales, Queensland, South Australia, Tasmania and Victoria as follows:
- NSW from $47.35 to $48.35;
- Queensland from $47.35 to $48.35;
- South Australia from $47.35 to $48.35;
- Tasmania from $47.35 to $48.35;
- Victoria from $47.35 to $48.35; and
- Private hospitals from $47.35 to $48.35.
