Legislative and Governance Forum on Food Regulation

Publication of Requests for a Review of Draft Food Standards

The Legislative and Governance Forum on Food Regulation (the Forum) is primarily responsible for the development of domestic food regulatory policy and the development of policy guidelines for setting domestic food standards.

After Food Standards Australia New Zealand (FSANZ) notifies the Forum of a draft standard or draft variation to the Australia and New Zealand Food Standards Code, the Forum has the capacity to adopt, amend or reject the standard or to request that the standard be reviewed. A review may be requested if the majority of jurisdictions consider that one or more of the following criteria applies to the standard:

  • It is not consistent with existing policy guidelines set by the Forum;
  • It is not consistent with the objectives of the legislation which establishes FSANZ;
  • It does not protect public health and safety;
  • It does not promote consistency between domestic and international food standards where these are at variance;
  • It does not provide adequate information to enable informed choice;
  • It is difficult to enforce or comply with in both practical or resource terms;
  • It places an unreasonable cost burden on industry or consumers.
