The Approved Provider applied on 23 January 2004 to have the sanction lifted. Further information was requested on 20 February 2004.

On 1 November 2007, the Agency advised that serious risk had been mitigated.

On 18 December 2007 transfer of places to Arcare Pty Ltd.

On 22 March 2005, the Agency advised that the serious risk had been mitigated.

On 22 March 2005, the Agency decided to vary the period of accreditation at the home to expire on 19 August 2005.

Following a Site Audit from 27-29 June 2005 the Agency decided to accredit the service for a period of nine months, expiring 19 May 2006.

Sanctions expired on 26 August 2005.

Facility: Belvedere Park Nursing Home

Reason for Sanction: The Approved Provider did not comply with all its responsibilities in relation to quality of care.
Current Status of Service: The Approved Provider has sought a reconsideration of the decision to impose sanctions. The original decision was confirmed on 4 September 2000. The Approved Provider applied for a stay of the sanctions. The hearing of the stay application was held on 29 September 2000. The application was refused.

The sanction expired on 2 August 2000.
Sanctions 2 Applied: No Commonwealth funding for new residents for a period of 12 months.

No further allocation of places for a period of 12 months.

Reason for Sanction: The Department asserted provider did not comply with all its responsibilities under the Accountability Principles.
Current Status of Service: The Approved Provider sought a reconsideration of the decision to impose sanctions.

The original decision was confirmed on 4 September 2000.

The Approved Provider applied to the Administrative Appeals Tribunal (AAT) for a stay of the sanctions.

The hearing of the stay application was held on 29 September 2000. The application was refused.

The Approved Provider applied to the AAT for review of the decision to impose the sanctions.

Sanctions set aside by AAT on 22 December 2000.

Sanctions Applied: On 16 August 2007 the following sanctions were imposed:
Sanction 1
Revocation of approval as a provider of aged care services from midday, Thursday 23 August 2007;

Sanction 2
Revocation of the allocation of all the places allocated to the approved provider to take effect from midday, Thursday 23 August 2007;

Sanction 3
Restrict approval as a provider of aged care services to aged care recipients to whom care is being provided at the Service.

Reason for Sanction: Immediate and severe risk to the health, safety and well-being of care recipients including widespread non-compliance across all the Accreditation Standards.
Current Status of Service: On 23 August 2007, the Administrative Appeals Tribunal ordered that the sanctions imposed on 16 August 2007 are to be stayed pending the hearing and determination of the approved provider's application for review of the imposition of sanctions or until an earlier order is made.

The order requires the approved provider to nominate and appoint an administrator who must be approved by the Secretary of the Department of Health and Ageing in accordance with the Aged Care Act 1997.

Review Audit Major Findings – Assessment Information (PDF 22474 KB) summarises the findings of Aged Care Standards and Accreditation Agency assessors who conducted a review audit at Belvedere Park Nursing Home on 6 August to 15 August 2007. Information that might identify individual residents or staff members has been deleted to protect their privacy.

The operator of the service has been invited to make a written response. The Aged Care Standards and Accreditation Agency will consider any written response from the operator when making a decision about the home’s accreditation.

The approved provider has appointed an administrator.

Sanctions expired 15 February 2008.

Current Status of Service: The Aged Care Standards and Accreditation Agency maintaining regular contact. The Approved Provider has appointed a (nurse) adviser. The Approved Provider has made an application to lift the sanctions.

The sanction was lifted 10 November 2000.
